Terms of Service — BRAINIX AI

Welcome to BRAINIX AI ("BRAINIX AI," "we," "us," or "our"), an AI-powered study companion app operated by Brainix Digital Studio / Pathan Tech Solutions. These Terms of Service ("Terms") govern your access to and use of the BRAINIX AI website (brainixai.in), mobile app, and related tools (together, the "Service").

By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

BRAINIX AI is an early-stage product. Features, tools, limits, and pricing may change as the product evolves.

1. Eligibility & Age Requirements

You must be at least 13 years old to create an account. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf, and that your use of the Service is permitted by them.
BRAINIX AI is intended for personal, educational use by students. It is not intended for commercial resale of its outputs.
If we learn that a user under 13 has created an account, we will suspend or delete that account.

2. Your Account

You must sign in using a valid Google or Apple account.
You are responsible for all activity under your account and for keeping your login credentials secure.
Do not share your account, or use another person's account, without permission.
Notify us immediately at brainixai.official@gmail.com if you suspect unauthorized use of your account.

3. Acceptable Use

You agree to use BRAINIX AI to learn, revise, and study. You agree not to:

Submit AI-generated output as entirely your own work without disclosure, where this would violate your school, college, or exam body's academic integrity policy;
Use the Service to cheat during a live, proctored, or closed-book exam;
Generate content that is illegal, harmful, hateful, harassing, sexually explicit involving minors, or that infringes another person's rights;
Attempt to reverse-engineer, scrape, data-mine, overload, or interfere with the Service or its infrastructure;
Use automated means (bots, scripts) to access the Service outside of any API we officially provide;
Circumvent usage limits, paywalls, or security features.

We may suspend or terminate accounts that violate this section, with or without notice, depending on severity.

4. AI-Generated Content — Disclaimer

Answers, summaries, explanations, and voice responses are generated by AI models and can be wrong, incomplete, biased, or out of date.
Always verify important information independently — especially before an exam, assignment submission, or any decision that matters.
BRAINIX AI is a study aid. It is not a substitute for your teacher, textbook, syllabus, or official exam guidance.
We are not responsible for academic, financial, or other consequences arising from reliance on AI-generated output.

5. Plans, Billing & Refunds

Free plan: includes daily usage limits per tool, as shown in the app.
Pro plans: ₹199/month or ₹2,000/year (or as updated in-app), unlocking higher or unlimited usage of select tools.
Prices, features, and limits may change. We will notify you of material changes before they take effect for existing subscribers where required by law.
Subscriptions renew automatically unless cancelled before the renewal date. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period.
Payments are processed by a third-party payment provider. We do not store your full payment card details.
Refunds: Except where required by applicable law, payments are non-refundable once a billing period has started. If you believe you were charged in error, contact brainixai.official@gmail.com within 7 days of the charge.

6. Content Ownership & License

You retain ownership of any content you submit to BRAINIX AI (questions, notes, documents, voice input, etc.) ("Your Content").
You grant us a limited, non-exclusive licence to process Your Content solely to operate and improve the Service — for example, sending it to our AI providers to generate a response.
We do not claim ownership of Your Content and will not sell it to third parties.
You are responsible for ensuring Your Content does not infringe anyone else's rights (e.g., copyrighted textbook material you upload).

7. Privacy

Our use of your personal data (including data from Google/Apple sign-in) is described in our Privacy Policy, which forms part of these Terms. By using the Service, you consent to that Privacy Policy.

8. Intellectual Property

The BRAINIX AI name, logo, app design, and underlying software are owned by us or our licensors and are protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks or branding except as needed to use the Service normally.

9. Termination

You may stop using BRAINIX AI and delete your account at any time.
We may suspend or terminate your account if you violate these Terms, misuse the Service, or if required by law.
On termination, your right to use the Service ends immediately; provisions that by nature should survive (e.g., Sections 4, 6, 10, 11) will survive termination.

10. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability.
To the maximum extent permitted by law, BRAINIX AI and its operators are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including academic outcomes, lost data, or loss of access.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months preceding the claim, or ₹500, whichever is greater.
Nothing in these Terms limits liability where prohibited by applicable law.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any dispute arising from these Terms or the Service will first be attempted to be resolved informally by contacting brainixai.official@gmail.com. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Ahmednagar, Maharashtra.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top shows the current version. For material changes, we will provide reasonable notice (e.g., in-app notice or email). Continued use of BRAINIX AI after changes take effect means you accept the updated Terms.
